SilentDisco.nl is a trade name of the sole proprietorship Villa The Duke, owner Sil Bouwmeester, hereinafter referred to as "SilentDisco.nl", "we" or "the rental company".

Other pick-up locations may be available by appointment, currently Oosterhout and Leiden. The pick-up location for a specific booking is stated in the quote or order confirmation. The available locations may change.
These terms and conditions apply to all quotes, bookings, rental agreements, deliveries, shipments, pick-ups, returns, and other services provided by SilentDisco.nl, unless otherwise agreed in writing.
The quote, the order confirmation, any additional written agreements, and these terms and conditions together form the agreement. If a specific written agreement deviates from these terms, the specific agreement prevails.
These terms are made available before the agreement is concluded: for a quote, by email via a link or attachment; for an order placed through the webshop, via a link in the checkout process. When ordering through the webshop, the customer expressly accepts these terms by ticking a consent checkbox.
Changes to these terms do not apply to agreements already concluded, unless the parties agree otherwise in writing.
A quote is non-binding unless stated otherwise in the quote. A quote may include a validity period, after which SilentDisco.nl may reassess availability and pricing.
A request, an informational email, or a verbal statement that equipment may be available does not constitute a confirmed booking.
A booking is confirmed when (a) the customer has expressly accepted the quote and SilentDisco.nl has confirmed the booking in writing, or (b) an order has been placed and paid for through the webshop in accordance with the checkout process used there.
After a booking is confirmed, SilentDisco.nl holds the agreed equipment and capacity available for the customer and will not rent it out to others during that period.
An option or provisional booking does not guarantee availability and expires after the period stated in the quote, unless otherwise agreed.
For business customers, SilentDisco.nl may assume that the person accepting a quote or confirming a booking on behalf of the organization is authorized to do so. Internal coordination issues, mistakes, staff absence, or handover between employees do not invalidate a confirmed booking.
The customer is responsible for providing accurate and complete information required to carry out the agreement, including name, contact and billing details, delivery address or DPD point, date of use, and the required number of headphones and other equipment.
The customer checks the order confirmation and reports any errors as soon as possible, and in any case before shipment or pick-up.
Changes to quantities, equipment, date of use, or delivery address only become final after written confirmation by SilentDisco.nl and may affect price and availability.
The applicable prices are stated in the quote, order confirmation, webshop, or current price list.
Prices shown to consumers include VAT. Prices shown to business customers may exclude VAT, in which case the VAT amount and the total amount are clearly stated.
Shipping costs, deposits, surcharges, and other additional costs are stated in advance in the quote, order confirmation, or checkout process.
Unless otherwise agreed in writing, payment must be made before shipment or pick-up. Payment by invoice may be agreed with business customers, in which case the payment term stated on the invoice applies.
In the event of late payment, the customer owes statutory (commercial) interest and extrajudicial collection costs once in default. For consumers, this only applies after the consumer has received a free reminder with a payment term of 14 days, and collection costs are calculated according to the statutory scale.
If payment is not made, SilentDisco.nl may suspend performance, withhold shipment of the equipment, or cancel the booking, without prejudice to its other rights.
For certain bookings, particularly larger ones, SilentDisco.nl may require a security deposit. The amount and payment method are stated in advance. The deposit is refunded within 14 days after correct return and inspection, less any outstanding amounts.
SilentDisco.nl deliberately ships well ahead of the date of use, to allow a buffer for any delay by the carrier.
The scheduled shipping date is stated in the order confirmation. This date determines the cancellation policy set out in Article 15.
For events later in the week, SilentDisco.nl normally ships at the start of that same week, usually on Monday or Tuesday. If the date of use falls early in the week, or if scheduling requires it, shipment may take place in the preceding week.
If SilentDisco.nl itself decides, after the agreement is concluded, to bring the shipping date forward, this will not negatively affect the customer's cancellation options. The original scheduled shipping date remains decisive, unless the customer agrees in writing to the new date.
SilentDisco.nl generally ships via DPD. Delivery usually takes one to two business days; delivery to a DPD point may take longer. Delivery times are indicative.
If a shipment is delayed, misdelivered, or taken to a pick-up point by the carrier, SilentDisco.nl will make reasonable efforts to assist the customer. To the extent permitted by law, SilentDisco.nl is not liable for indirect damage arising solely from a delay caused by the carrier.
The customer is responsible for providing the delivery address accurately and in good time. If the address is incorrect, incomplete, or inaccessible, additional shipping, return, or re-delivery costs may be charged.
Changing the delivery address after shipment may cause delays. In that case, SilentDisco.nl cannot guarantee the original delivery time.
If choosing a DPD point, the customer must select a regular DPD point (not a DPD locker, as the boxes do not fit) and must collect the shipment in good time.
If a shipment is not collected in time, is refused, or is returned due to an error by the customer, the obligations under the rental agreement remain in force and additional shipping and handling costs may be charged.
For pick-up, the equipment is handed over at the agreed location and time, as stated in the order confirmation.
The rental period runs from delivery or pick-up up to and including the return date. The rental price is based on use on the agreed date of use. Delivery of the equipment a few days before the date of use is a courtesy and does not result in additional costs.
In the case of shipment, the customer must hand in the equipment at a DPD point in accordance with the return instructions no later than 12:00 noon on the first business day following the date of use, unless a different return date is stated in the order confirmation.
Use on multiple days is possible by arrangement and may result in an adjusted price, among other things due to the chargers required.
Extension of the rental period is only possible after prior consultation, subject to availability, and after written confirmation by SilentDisco.nl.
The customer returns all equipment complete, clean, dry, and in the agreed manner.
For shipped returns, the customer uses the supplied return label, the supplied packaging and fastening materials (including cable ties), and the agreed carrier. If multiple boxes are used, the customer uses the correct number of return labels and distributes the equipment correctly across the boxes.
If the equipment is returned later than the return date, the customer owes 50% of the agreed rental price (excluding shipping costs) for each additional day, in addition to any demonstrable extra costs arising from the late return.
If a late return means that a subsequent booking cannot be fulfilled, or can only be fulfilled at additional cost, SilentDisco.nl may recover the costs directly resulting from this from the customer, to the extent permitted by law.
If additional shipping or return labels are needed due to the customer's actions, € 15.00 per label will be charged.
If the equipment has not been returned 14 days after a written reminder, SilentDisco.nl may consider the equipment lost and charge the replacement value set out in Appendix 1. The late-return fee is no longer due for the period after that point.
The customer handles the equipment with care, uses it only for its intended purpose, and follows the supplied manuals and instructions.
It is not permitted to open, disassemble, repair, or modify the equipment; to attach stickers, glue, or tape to it; to resell or sub-rent it; to make it available to third parties outside the customer's own event; or to expose it to water, rain, other liquids, or extreme heat.
When used outdoors, the customer protects the equipment against rain, moisture, and other weather conditions. Food, drinks, smoke, mud, sand, make-up, confetti, and other contaminants are kept away from the equipment.
When used by children or persons who cannot responsibly handle the equipment on their own, the customer ensures appropriate supervision.
The customer takes adequate measures against theft, loss, and unauthorized use, and does not, for example, leave equipment unattended or visibly left in a vehicle.
The equipment may only be charged using the supplied or specified chargers.
Each transmitter requires its own suitable music source. The customer is responsible for the suitability of their own phones, tablets, laptops, DJ sets, and adapters. Problems caused by an unsuitable music source, a missing adapter, incorrect use, or failure to follow instructions are not considered a defect in the equipment.
The customer inspects the equipment immediately upon receipt or pick-up for completeness and visible damage, and reports any missing or damaged equipment as soon as possible, preferably before the event.
The customer is liable for damage to, loss of, and theft of the equipment occurring during the period the equipment is in the customer's possession, unless the customer demonstrates that the damage cannot be attributed to them or to persons for whom they are responsible. Normal wear and tear is not at the customer's expense.
Damage includes, among other things, damage caused by water, moisture, rain, or other liquids; dropping or impact; smoke; overheating; self-made modifications or repairs; stickers, glue, or tape; inadequate security; negligence; and use contrary to the instructions.
In the event of damage, the reasonable costs of repair or cleaning are charged, up to a maximum of the replacement value. If an item cannot be repaired, or is lost or stolen, the replacement value set out in Appendix 1 is charged. This also applies to missing parts and accessories.
Any deposit paid may be offset against amounts owed for damage, loss, cleaning, late return, and other outstanding amounts.
SilentDisco.nl delivers the equipment inspected and, as far as possible, fully charged.
If the customer notices a problem before or during the event, they contact SilentDisco.nl immediately by phone, WhatsApp, or email.
SilentDisco.nl makes reasonable efforts to resolve problems remotely as quickly as possible or, where reasonably possible, to arrange replacement equipment.
If equipment is unusable due to a defect that cannot be attributed to the customer, and SilentDisco.nl cannot offer a reasonable solution, the rental price for the unusable part is reduced or refunded on a pro-rata basis.
SilentDisco.nl is not liable for damage arising because the customer failed to report a problem in time, as a result of which a solution was no longer possible.
A rental agreement for equipment for an event or activity on a specific date or within a specific period constitutes a service agreement relating to leisure activities with a specified date or period of performance, within the meaning of Section 6:230p of the Dutch Civil Code. The statutory right of withdrawal (14-day cooling-off period) therefore does not apply. SilentDisco.nl informs the consumer of this before the agreement is concluded, including in the quote and during the checkout process.
Instead, the cancellation policy set out in Article 15 applies.
If a consumer purchases equipment or accessories remotely (as a sale, not a rental), the statutory right of withdrawal of 14 days after receipt applies. In that case, the conditions and the model withdrawal form are sent together with the order confirmation.
Cancellation must be made in writing, for example by email. The moment SilentDisco.nl receives the cancellation is considered the moment of cancellation.
Cancellation costs are determined based on the scheduled shipping date (or pick-up date) stated in the order confirmation, not the date of use. The order confirmation also states the last date on which free cancellation is possible.
The following policy applies, based on calendar days:
Transport costs already incurred that reasonably cannot be cancelled and are not part of the rental price may be charged in addition.
The cancellation policy applies regardless of the reason, such as bad weather or a changed weather forecast, illness, internal planning, a lower number of participants, or a changed format of the event. SilentDisco.nl may offer goodwill exceptions in individual cases; this does not set a precedent.
Rescheduling an event is considered a cancellation, unless SilentDisco.nl agrees in writing to a new date. A new date is subject to availability and may result in an adjusted price.
Any refundable amount is repaid within 14 days of processing the cancellation, less any applicable cancellation costs and other outstanding amounts.
Once the equipment has been delivered or picked up, the agreed rental price remains due, even if the equipment is not used, is only partially used, or the event ends early.
Circumstances on the customer's part, such as not reading the instructions, lacking a suitable music source, or not connecting the correct equipment, do not entitle the customer to a reduction or refund of the rental price.
The customer ensures a suitable and safe location. When used outdoors, the equipment is protected against rain, moisture, extreme heat, and other harmful conditions.
A poor weather forecast or cancellation of an event due to weather does not entitle the customer to free cancellation; Article 15 continues to apply, unless otherwise agreed in writing.
The customer is solely responsible for any required permits, venue permission, music rights and licenses, and other obligations relating to the event.
SilentDisco.nl is not liable if it is unable to fulfil its obligations, or unable to do so in time or in full, due to circumstances beyond its reasonable control, such as serious technical failures, fire, theft, unexpected failure of a large part of the equipment, extreme weather conditions, carrier disruptions or problems, government measures, and power outages.
In that case, SilentDisco.nl informs the customer as soon as possible and offers an alternative where possible. If performance proves definitively impossible, the amount paid for the part not performed is refunded within 14 days.
Circumstances on the customer's part as a result of which the customer no longer wishes or is able to use the equipment do not constitute force majeure on the part of SilentDisco.nl and are governed by Article 15, unless mandatory law provides otherwise.
SilentDisco.nl performs the agreement with due care.
If SilentDisco.nl is liable for direct damage resulting from an attributable failure, that liability is limited to the amount paid for the agreement in question.
SilentDisco.nl is not liable for indirect damage, such as consequential damage, business damage, lost revenue, lost profit, reputational damage, travel or accommodation costs, or damage caused by an event not being able to proceed, or not proceeding in full.
SilentDisco.nl is not liable for damage caused by incorrect use, failure to follow instructions, unsuitable equipment or music sources provided by the customer, failure to report malfunctions or damage in time, incorrect information provided by the customer, or circumstances at the event location beyond SilentDisco.nl's control.
The limitations in this article do not apply in the case of intent or deliberate recklessness on the part of SilentDisco.nl, nor to the extent that mandatory law does not permit limitation or exclusion.
The customer may not sell, pledge, rent out, or otherwise make the equipment available commercially to third parties without SilentDisco.nl's prior written consent.
Guests, participants, employees, and other attendees of the customer's event may use the equipment. The customer remains fully responsible for the equipment at all times.
SilentDisco.nl supplies the type and quantity of equipment described in the quote. If an item is unexpectedly unavailable, SilentDisco.nl may supply an equivalent or newer alternative, provided functionality is not materially reduced. Any material difference is discussed with the customer in advance where reasonably possible.
The customer reports complaints about delivery, completeness, or functioning as soon as possible after discovery. Visible damage or missing parts are preferably reported immediately upon receipt and no later than before the event.
A complaint does not automatically suspend the payment obligation, unless required by law or unless SilentDisco.nl confirms otherwise in writing.
SilentDisco.nl first attempts to resolve complaints through mutual consultation and provides a substantive response to a written complaint within 14 days.
SilentDisco.nl processes personal data in accordance with the General Data Protection Regulation (GDPR). More information is available in the privacy policy on www.silentdisco.nl.
Dutch law applies to all agreements with SilentDisco.nl. For consumers residing in another country, such as Belgium, the protection of mandatory consumer rules of their country of residence continues to apply.
The parties first attempt to resolve any dispute through mutual consultation.
Disputes with business customers are submitted to the competent court in Amsterdam. For consumers, the statutory rules on the competent court apply.
If a provision of these terms is invalid or is annulled, the remaining provisions remain in force. The parties will then agree on a valid provision that most closely matches the original purpose.
